Activist moves to court to challenge plastic bag ban
Human Rights Activist Okiya Omtatah has moved to court contesting the plastic bags ban on the basis that it was anchored on an illegal gazette notice.
Omtatah, whose case has since been consolidated with that of plastic bags manufactures told the court that the Attorney General together with the National Environment Management Authority (NEMA) blackmailed the court to allow the ban to take effect despite relying on an illegal gazette notice.
He argues that since the ban took effect, there have been losses both to manufacturers and individual citizens who have since lost their jobs directly and indirectly.
The High Court has, however, refused to grant conservatory orders lifting the ban on the basis of the effect the ban lift will have on majority of Kenyans.
The case, however, was referred to the Chief Justice to constitute a bench to hear the matter.
The matter will now be heard on notice to the parties.
